Media Law Institute defends journalist’s right to information about public procurement

The Media Law Institute has lodged an appeal against the refusal by the State Property Fund to provide journalist Ihor Lutsenko with public information regarding public procurement

The Media Law Institute has lodged an appeal against the refusal by the State Property Fund to provide journalist Ihor Lutsenko with public information.

Five months ago the journalist asked to see the documents linked with the valuation of Kyivenergo before the sale by tender of 25% of its shares. Ihor Lutsenko aslso asked to see the documents on the tender.

The Stat Property Fund only provided part of the documents, refusing to show the document giving the valuation of Kyivenergo’s shares, the tender applications and all additional documentation from the bidders, as well as the protocol from the tender commission. It asserted that the information was for internal use only.

Article 6 of the Public Information Act states that access may not be restricted to information about the use of public funding, the ownership, use and disposal of State-owned or municipal property, including copies of the relevant documents, agreements on receipt of this money or property, the full names of the individuals or legal entities who received the money or property.  Ihor Lutsenko accordingly lodged a complaint against the refusal to provide the information and documents with the court which rejected it.  The Medial Law Institute will be representing Ihor Lutsenko at appeal level.
