“Maidan” Alliance activist to fight Kuchma’s Decree in court

The latest move to eradicate illegal stamps restricting access to information and other means using by those in power to conceal their activities from public scrutiny

On 8 September the “Maidan” Alliance’s legal adviser Oleksandr Severyn lodged an administrative suit with the Pechersky District Court in Kyiv.  He is calling for point 7 of the Presidential Decree № 503/97 “On the procedure for official publication of normative legal acts and their gaining of legal force” to be recognized as contravening legal acts of higher legal force and invalid.

As already reported, it was specifically this point (where the possibility is envisaged of not publishing acts which “are not of general significance”) which have been used by state gentlemen and ladies to excuse their shameful practice of classifying normative legal acts, in particular, using the illegal stamps restricting access “Not to be printed” and “Not to be published”.
