Regulations restricting peaceful assembly in Dniepropetrovsk fully quashed

The rejection of the Dnipropetrovsk city authorities’ appeal has hopefully knocked these most draconian regulations on the head. Now it’s the turn for the others.

As reported already, the battle waged by human rights defenders to have the “Regulations on holding mass events in the city of Dnipropetrovsk” passed in 2003 quashed, had its first success 2 months ago.

On 5 June the Dnipropetrovsk Regional Appeal Administrative Court heard an appeal from the Dnipropetrovsk City Executive Committee against the ruling of the Babushkinsky District Court in Dnipropetrovsk. The latter had allowed a civil suit brought by Andriy Shulyak, representing the “Respublika” Institute, and declared the Regulations to be unlawful.

The Appeal Court rejected the appeal.

This means that as of 5 June the “Regulations on holding mass events in the city of Dnipropetrovsk” (the most draconian of all such regulations in Ukraine) have become null and void.

This is an important precedent and a victory for human rights defenders.

It is likely that a cassation appeal will be lodged, but it does not have much chance of success.
