Kuchma’s lawyers get criminal investigation reopened against Melnychenko
The Pechersky District Court in Kyiv has revoked the decision issued by former Prosecutor General Sviatoslav Piskun from 1 March 2005 which terminated the criminal investigation initiated against former Security Guard to ex-President Kuchma, Mykola Melnychenko.
Judge Rodion Kreyev thus allowed the appeal against termination of the investigation lodged by Kuchma’s lawyers.
The court ruling states that the case was closed without comprehensive study of the circumstances, for example, Melnychenko was not interrogation. It considers unmotivated and premature the argument that he had made the tapes out of extreme necessity.
The court therefore decided that the Prosecutor’s conclusions at play when taking the deicison to close the case were unfounded.
The deicison is therefore revoken and sent to the Prosecutor General for the investigation to be restarted.
The ruling can be appealed within the next 7 days.
