Verdict in Ivashchenko case possible in April

In one of the cases of concern both within Ukraine and abroad, the Prosecutor claims Valery Ivashchenko’s guilt is proven, while the defence speaks of falsified material, a biased attitude from the investigators and the lack of any actual crime

The public prosecutor considers that a verdict may be handed down in April in the trial of former Acting Defence Minister in Yulia Tymoshenko’s government, Valery Ivashchenko. The Prosecutor asserts that his guilt is proven.  Ivashchenko’s defence lawyers speak of the case material being falsified and of the biased approach of the investigators.

Valery Ivashchenko has been in detention since August 2010, with his detention and prosecution being among the main cases mentioned in all reports and resolutions concerning the allegations of selective prosecution.   He is charged with having, in November 2009 while Acting Minister of Defence abused his position by signing a plan to sell the Feodosia Marine Engineering Works which was property of the Ministry of Defence.  More details can be found in the Second Preliminary Report by the Danish Helsinki Committee on Human Rights, where Valery Ivashchenko’s case is one of those examined

Valery Ivashchenko asserted in court that the investigators had not tried to establish the truth, but simply prove that he was guilty. He says that material handed to the court was re-formatted in comparison with that which was shown him and his lawyers. He says that there are even traces of this in the fact that pages 104 and 105 turned into pages 167 and 168.

The Prosecutors in their turn claim that Ivashchenko and his lawyers are trying to drag out the case.  Prosecutor Petro Koval who is in charge of the prosecution team says that more than 38 volumes of material have been examined and that the court could issue its verdict in April.

Boris Nechyporenko, Ivashchenko’s lawyer, says that the former Acting Defence Minister did everything in his power while in office to prevent unlawful sale of the Feodosia Marine Engineering Works for a deliberately lower price.  He says that the case is falsified and that the people who should be on trial are those who sold the property, not the Acting Defence Minister. He says that Ivashchenko has already pointed out one instance of falsification, and that there is no element of crime in his client’s actions and could not be since Ivashchenko did not have any connection with the unlawful sale of property.
