All argument is over regarding the compensation of 2 million UAH awarded to the family of Svitlana Zaitseva who died of tuberculosis contracted while serving a sentence for a crime she did not commit

All argument is over regarding the compensation of 2 million UAH awarded to the to the family of Svitlana Zaitseva.  The Donetsk Regional Court of Appeal on 22 January 2007 upheld the ruling of a Donetsk court already reported here in November. 

Given the circumstances of the case, it seems strange that the judgment was appealed at all, however the amount is enormous, the largest ever awarded by a Ukrainian court over wrongful actions by the law enforcement agencies.  Olha Ponomaryova, Judge of the Court of Appeal stated that the Central Department of the State Treasury had withdrawn their appeal against the November ruling.

Svitlana Zaitseva was sentenced to seven and a half years imprisonment for a murder she did not commit.  She had “confessed” to the crime during the criminal investigation, apparently under duress.

A year later the real killer was found, and she was totally cleared and released however she returned home with tuberculosis.  She died in April 2006 leaving three children. The post-mortem from doctors whom Svitlana had, until her imprisonment, only visited in connection with her pregnancies, concludes that she had tuberculosis of both lungs contracted in a penal institution.
