Oleksy Podolsky recognized as a victim in the case against Oleksy Pukach who is charged over the murder of journalist Georgy Gongadze complains that on 28July he was prevented by police officers from entering even the courtyard of the Court.

Oleksy Podolsky is one of the formally recognized victims in the case against Oleksy Pukach who is charged over the murder of journalist Georgy Gongadze, He has made a formal submission to the Pechersky District Court in Kyiv in which he asserts that on 28July he was prevented by police officers from entering even the courtyard of the Court.

He says that in the presence of witnesses he showed his passport to a senior police office of the police cordon, Lieutenant O. Reshovsky and stressed both his constitutional right to turn to a body of justice at any time and his right to take part in the court trial where he has victim status.

The police officer categorically refused to admit him, saying that he had not received a court summons. 

Podosky said that during the previous court hearings he had told the presiding judge and the court secretary of the obstacles which the police put in his way, and asked that he receive a summons for each of the next hearings.  This has not been forthcoming.

“I am convinced that it is the Pechersky District Court  which is using the police to impede my right to take part in the court trial as victim”.

He links this with his uncompromising position regarding the “commissioned murder” of the main witness in the case, the former Minister of Internal Affairs, Yury Kravchenko (who is alleged to have committed suicide in January 2005 – translator).

As reported, Valentina Telychenko, the lawyer representing Myroslava Gongadze has also criticized the course of the trial against Pukach.  On Thursday, telling journalists of the latest postponement of the next hearing to 11 August, she suggested that they compare the timeframes for hearing the Pukach case and those for the trials of the former Prime Minister Yulia Tymoshenko and former Minister of Internal Affairs, Yury Lutsenko.  The Pukach trial was passed to the court much earlier, yet is scarcely moving, while the trails of Tymoshenko and Lutsenko are going at full pace.  She believes that this, as well as the non-transparent manner by which judges are selected, shows the court’s selective justice.

On 28 July Pukach’s lawyer  stated that the hearing had been deferred because Oleksy Podolsky does not have access to State secrets and that when this would appear depended on the SBU [Security Service].”
