ECHR asks for information regarding medical care for detainee
The European Court of Human Rights has asked the Ukrainian Government to provide information about the specific medical care being provided a detainee at the Lukyanivsk SIZO in Kyiv who has AIDS.
The detainee’s lawyer, Ivan Ovsiyenko reports that his client is not receiving proper treatment and his state of health is life-threatening. He has lost 20 kilograms in weight, has ulcers which are not healing; is experiencing pain in the liver and kidneys and other problems.
In view of this Kharkiv Human Rights Group lawyers approached the European Court of Human Rights and asked the Court to order urgent measures under Rule 39 of the Regulations. Where a person is gravely ill and not receiving proper treatment, the Court recommends that he be urgently transferred to a hospital for examination and treatment. The Court is now awaiting information from the Ukrainian authorities.
It has also arranged that the application alleging violation of Article 3 of the Convention should be considered as soon as possible.
