TVi: Khoroshkovsky by law cannot be a member of the High Council of Justice

TV Channel TVi has called on the President to cancel his Decree appointing Valery Khoroshkovsky member of the High Council of Justice, citing Article 6 of the Law on the High Council of Justice. This article stipulates the qualifications needed which include: “a higher legal education and experience of work in the field of law of no less than ten years. The requirements of paragraph 1 of this Article do not apply to people who are members of the High Council of Justice on the basis of their position”.

TVi believes that Head of the Security Service and unofficial media owner Valery Khoroshkovsky deceived the President’s Administration by not informing them that he does not have the right to hold this position.

They point out that his biography indicates that he does not have the experience, and that those who are members of the Council on the basis of their position are the Head of the Supreme Court, the Minister of Justice and the Prosecutor General.

The Deputy Head of the President’s Administration, Anna Herman advised the television company to submit an information request.

Telekritika has made a formal request for information regarding the legal grounds for Khoroshkovsky’s appointment and also asking what the Administration’s response will be to the TVi statement, and is awaiting response.

The television channel representatives are diplomatic or unaware of certain utterances at the time of Mr Khoroshkovsky’s appointment.  We quote:

“Members of the Parliamentary Committee on Justice Issues gave different assessments. According to Yury Karmazin, the First Deputy Head of the Committee (from Our Ukraine – People’s Self-Defence] “It’s not even funniy! He’s not a specialist in this area”.  Deputy Chair of the Committee, and member of the High Council Valery Bondyk (Party of the Regions) says: “Khoroshkovsky is a professional administrator who has demonstrated his ability in customs and in the SBU. The fact that he isn’t a professional lawyer is not important”.

Mr Karmazin expressed concern that President Yanukovych and his party allies control more than half the votes in the High Council of Justice. “The judiciary is subordinated to one political force”.
