Judge Kireyev has just returned and rejected the application made this morning by Prosecutor Frolova to remand the former Prime Minister and present leader of the opposition Batkivshchyna Party in custody.

Frolova had claimed that Yulia Tymoshenko was, through her actions, impeding the court from ascertaining the truth. She cited Article 148 of the Criminal Procedure Code and claimed that there were grounds for such a restraint measure.

Had Judge Kireyev acceded, this would have been in front of members of various countries’ diplomatic corps who are, together with their governments and the international community following this case very closely.

Ms Tymoshenko is accused of abuse of her powers over the signing of a gas accord with Russia at the beginning of 2009.  This restored gas supplies to Europe which had been cut off due to a dispute between Russia and Ukraine over gas payments.
