Appeal Court finds in TVi’s favour in earlier dispute with Broadcasting Council

On 20 September the Kyiv Administrative Court of Appeal upheld the first instance court ruling which revoked a decision by the National TV and Radio Broadcasting Council to issue the independent TV channel TVi with a warning.

According to TVi’s lawyers Oksana Yefimchuk and Yury Krainyak (from Jurimex) both courts have confirmed that the decision to hold TVi liable for infringements of broadcasting legislation was unlawful. It is now revoked.

The Broadcasting Council’s Press Service told Telekritika that they would comment only after receiving all documents.

On 28 March 2011 the Broadcasting Council issued TVi with a warning for having not, over the space of a year, begun broadcasting in a number of cities in the Crimea and had only begun test broadcasting in the Ivano-Frankivsk village of Verkhni Yaseny and then stopped it.  The Broadcasting Council also found that there were discrepancies with the licence requirements – films being shown for 5 hours not 13.
