OSCE PA adopts resolution defending Ukraine’s territorial integrity and condemning Russia’s hybrid warfare

In a document adopted at its annual meeting in Minsk, the Parliamentary Assembly of the Organization for Security and Cooperation in Europe has urged the Russian Federation to free all Ukrainian political prisoners and to stop sponsoring terrorist activities in Ukraine by sending militants, money and weapons across the uncontrolled section of the Ukraine-Russia border. 

The resolution was originally proposed by the Ukrainian delegation, and supported by a large majority (91 participants).  15 countries voted against, including Russia and three abstained.  

The document was part of the Minsk Declaration which sets out recommendations for national governments, parliaments and the international community to respond to the pressing challenges and threats facing them.  The Russian Federation voted against the entire Declaration.

The OSCE Parliamentary Assembly’s 26th Annual Session in Minsk (Belarus) has adopted the Resolution on “Restoration of the Sovereignty and Territorial Integrity of Ukraine”

The decision to adopt the Resolution on “Restoration of the Sovereignty and Territorial Integrity of Ukraine” was taken by the OSCE PA Committee on Political Affairs and Security within the framework of the 26th Annual Session of the OSCE Parliamentary Assembly on July 7, 2017 in Minsk, the Republic of Belarus.

The draft of the resolution was prepared and triggered by Artur Herasimov, the Head of the Ukrainian Parliamentary Permanent delegation to OSCE PA. The document was accepted by outright majority (just Russia and Serbia gave their nays) with some prior amendments approved by the Ukrainian delegation.

The text of the Resolution on “Restoration of the Sovereignty and Territorial Integrity of Ukraine” presents some moments of critical significance, including that the Organization for Security and Co-operation in Europe Parliamentary Assembly:

- Reaffirms its full respect for the sovereignty, independence, unity and territorial integrity of Ukraine within its internationally recognized borders, which include the Autonomous Republic of Crimea and the city of Sevastopol;

- Reiterates its condemnation of the temporary occupation of the Autonomous Republic of Crimea and the city of Sevastopol by the Russian Federation and the ongoing Russian hybrid aggression against Ukraine in Donbas;

- Recognizes that the Russian Federation has completely failed to implement the provisions of the previous OSCE Parliamentary Assembly Resolutions on violations of fundamental Helsinki principles and international norms on human rights in the temporarily occupied Autonomous Republic of Crimea and the city of Sevastopol (the OSCE Parliamentary Assembly’s Resolution on Clear, Gross and Uncorrected Violations of Helsinki Principles by the Russian Federation (2014), Resolution on the Continuation of Clear, Gross and Uncorrected Violations of OSCE Commitments and International Norms by the Russian Federation (2015), Resolution on Adherence to the Helsinki Principles in Inter-State Relations Across the OSCE Area (2015), and Resolution on Violations of Human Rights and Fundamental Freedoms in the Autonomous Republic of Crimea and the City of Sevastopol (2016));

- Urges the Russian Federation to reverse the temporary occupation of the Autonomous Republic of Crimea and the city of Sevastopol, to withdraw the Russian occupation forces from the temporarily occupied Autonomous Republic of Crimea and the city of Sevastopol and to bring them back under the control of the Government of Ukraine;

- Calls on the Russian Federation to ensure the withdrawal of its armed formations, military equipment, and mercenaries from the territory of certain areas of the Donetsk and Luhansk regions of Ukraine under monitoring of the OSCE, as well as disarmament of all illegal armed formations;

- Calls on the Russian Federation to strictly abide by the norms and principles of international law, OSCE principles and commitments, and the Minsk Agreements, and to immediately release Oleg Sentsov, Oleksandr Kolchenko, Mykola Karpyuk, Stanislav Klyh, Roman Sushchenko and other Ukrainian citizens who are illegally detained in the Russian Federation, as well as to ensure their safe return to Ukraine;

- Encourages the OSCE Chairmanship, OSCE Institutions and participating States to make efforts and use all instruments available to facilitate the release of all abducted and illegally detained Ukrainian citizens who have become political prisoners in Russia;

- Calls upon the Russian Federation to immediately grant unimpeded access to the temporarily occupied Autonomous Republic of Crimea and the city of Sevastopol to international agencies, institutions, special procedures, and independent experts of the OSCE, the United Nations, and the Council of Europe, as well as to any human rights NGOs or media outlets that wish to visit, assess, and report on the situation in the temporarily occupied Autonomous Republic of Crimea and the city of Sevastopol;

- Calls on participating States to strictly refrain from any steps that could lead to direct or indirect recognition of the results of the illegal elections to the State Duma of the Federal Assembly of the Russian Federation in the temporarily occupied Autonomous Republic of Crimea and the city of Sevastopol (Ukraine);

- Urges the Russian Federation to stop sponsoring terrorist activities in

Ukraine through the inflow of fighters, money, and weapons across the non-Government controlled segment of the Ukrainian-Russian state border, and to terminate all support for illegal armed formations in certain areas of the Donetsk and Luhansk regions of Ukraine that engage in acts of terrorism in Ukraine, etc.

The above Resolution adopted by the OSCE PA Committee on Political Affairs and Security is to become a part of the general Minsk Declaration of the 26th Annual Session of the OSCE Parliamentary Assembly to be accepted at the plenary session on July 9, 2017
