SECRET MATERIAL WHICH THE REGIME CONCEALED UNDER STAMPS “NOT TO BE PRINTED” AND “NOT TO BE PUBLISHED”
The right to information is identified as fundamental in both the Constitution of Ukraine and the European Convention on Human Rights and Fundamental Freedoms. For any state which claims to be based on the rule of law, for any society which wishes to be free, observance of this right is of vital importance. The bearers of sovereignty – the people should yield control over the authorities. This, however, is possible only where they are well informed about the latter’s activities.
All regimes demonstrate to varying degrees a lack of enthusiasm for such control. Evidence of the wish of those in power to avoid control and of their irresponsibility and legal nihilism can be seen in the classification of normative acts under the illegal stamps restricting access such as “Not to be printed” and “Not to be published”.
Running a campaign to have all “secret” material made public, launched at the beginning of 2005 on the initiative of Co-Chair of the Kharkiv Human Rights Protection Group, Yevhen Zakharov and by means of drawing the public’s attention to the issue, exerting pressure on the authorities and through civil suits, the “Maidan” Alliance has achieved a number of significant victories, among which the following should be highlighted.
1. There has been a significant decrease in the number of normative acts which are assigned illegal stamps restricting access. Whereas President Kuchma issued around 900 acts bearing such stamps, Prime Minister Yanukovych – approximately 100, President Yushchenko has issued 44 (42 Decrees, 2 Instructions, of which 40 were passed before 1 April, and since 1 November 2005 there has not been one). Yulia Tymoshenko when Prime Minister issued 15 (as well as two Instructions under the stamp “For official use only”), while Yury Yekhanurov, who succeeded her, published none (except for one resolution bearing the stamp “For official use only”).
2. Of fundamental significance was the official acknowledgement by the Ministry of Justice of Ukraine that the use of stamps restricting access not allowed for by legislation is illegal.
3. The disclosure, after repeated demands from human rights and civic activists, first of the names of 96 resolutions and instructions issued under the government of Viktor Yanukovych, and recently of 295 acts issued by all Ukrainian governments with illegal stamps restricting access, beginning from January 2001.
It will be seen that an analysis of the names of these normative acts demonstrates that there were a fair number of documents on matters of defence. However, with regard to the majority of documents, serious suspicions are aroused both as to the justification for there having been classified as secret, and as concerns the legality of carrying out the activities which the acts envisage. Such documents can be divided into three categories: corrupt activities; various perks and benefits for high-ranking officials; behind the scenes political deals. The question is clear and straightforward: if there is nothing illegal in these acts, why conceal them from the people?
Therefore, at the current stage of our campaign, we are demanding that all illegal stamps restricting access be removed from all normative acts issued by any Ukrainian state bodies. Those of them which do in fact contain state secrets, should be classified as state secret in accordance with the Law of Ukraine “On state secrets”, or as information bearing the stamp “For official use only”. The others, however, should, with no exceptions and in full, be made open to the public. We are also calling for amendments to be made to the Law “On Information”, with a clear definition provided of what kinds of items of information can be classified as of limited access. The practice of concealing information about the activities of the state must be stopped. We will seek to achieve this both by lodging civil suits (as is already underway), and by lobbying for high-quality draft laws. Our aim is to train those in power, regardless of their political colours, in transparency and responsible leadership.

The Ministry of Justice of Ukraine has reviewed your letter concerning the grounds for the application of stamps restricting access to normative legal acts and has the following comments.
Classifying normative legal acts with stamps restricting access, which is not envisaged by legislation, is a violation of the rights of citizens to access to legal information. The Ministry of Justice of Ukraine has carried out an analysis of acts issued by the Cabinet of Ministers of Ukraine over the years 1991 – 2005 with the stamps restricting access: “Not to be printed” and “Not to be published” which are not allowed for by Ukrainian legislation.
As a result of their analysis, the Ministry of Justice of Ukraine has approached the Cabinet of Ministers suggesting that they give instructions with regard to the inadmissibility of future use of the above-mentioned stamps limiting access and to the publication of acts previously issued by the Cabinet of Ministers bearing these stamps.

We would also inform you that in accordance with the instruction of the Cabinet of Ministers of Ukraine, the chief designers of legislative acts of the Cabinet of Ministers of Ukraine are presently undertaking an expert assessment of those legislative acts of the Cabinet of Ministers of Ukraine bearing the stamps “Not to be printed” and “Not to be published” (in accordance with the Instructions for the procedure of accounting, storage and use of documents, cases, publications and other physical forms of information, containing confidential information which is the property of the State, approved by Resolution № 1893 of the Cabinet of Ministers of Ukraine from 27 November 1998)
Should confidential information which is the property of the State be found, then proposals will be prepared for classifying the said acts with a stamp restricting access which is allowed for under Ukrainian legislation. If such information is not found to be present, then proposals will be issued to have the stamps “Not to be printed” and “Not to be published” removed , and to have the acts published in accordance with established procedure.
