At their meeting on 12 October, the Ministers "expressed their serious concern about the trial of Yulia Timoshenko and the verdict, sentencing her to a 7 year prison term and a 3 year ban on holding office, as well as the ongoing trials of other Ukrainian public figures, and the perception of selective and politically motivated justice"

 

At their meeting on 12 October, the Committee of Ministers of the Council of Europe expressed serious concern over the trial of former Prime Minister Yulia Tymoshenko, asking the Secretary General of the Council of Europe Thorbjorn Jagland to bring its concerns to the attention of the Ukrainian authorities,

Decisions

The Deputies

1. recalled the obligations and commitments placed on member states by the Statute of the Council of Europe and the European Convention on Human Rights;

2. underlined the specific responsibility of Ukraine as chair of the Committee of Ministers to ensure that these obligations and commitments are respected;

3. expressed their serious concern about the trial of Yulia Timoshenko and the verdict, sentencing her to a 7 year prison term and a 3 year ban on holding office, as well as the ongoing trials of other Ukrainian public figures, and the perception of selective and politically motivated justice;

4. highlighted the importance they attach to pursuing effective co-operation with Ukraine to strengthen the functioning of democratic institutions and the rule of law in Ukraine;

5. asked the Secretary General to bring their concerns to the attention of the Ukrainian authorities;

6. asked the Secretary General also to pursue his dialogue with the Ukrainian authorities on ways of developing an independent judiciary and implementing a legislative framework in line with Council of Europe standards, possibly through intensifying efforts under relevant provisions of the recently adopted Action Plan for Ukraine, including the provision of Council of Europe expertise;

7. asked the Secretary General to report back to them on his dialogue with the Ukrainian authorities at their next meeting.
