Banks prohibited from divulging confidential information about customers in arrears
The Ministry of Justice has cancelled the state registration of the norm of a decision by the Board of the National Bank of Ukraine which enabled banks to hand over information containing bank secrets to private individuals and organizations.
The Ministry considers that debt collector firms should only be provided with the banks confidential information on the written request or consent of the debtor.
It believes that otherwise such activity infringes the rights and interests of individuals protected by law and could be qualified as a crime under, for example, Article 182 of the Criminal Code which imposes liability for infringements of the inviolability of private life, 189 – for extortion, 144 – for coercion in fulfilling or not fulfilling obligations under civil law.
