Constitution of Ukraine. A draft

This edition is an English translation of the full-scale annotated model draft of the new Constitution of Ukraine—2023. The author of the draft is Vsevolod Rechytskyi—Chairman of the Council of the Kharkiv Human Rights Protection Group,  associate professor at the Ukrainian Catholic University (Lviv, Ukraine).

The model draft is one of the results of creative research of the Ukrainian Helsinki Human Rights Union (UHHRU) and the Kharkiv Human Rights Protection Group (KHPG) in the area of modern Ukrainian constitutionalism, the protection of human rights and fundamental freedoms in Ukraine in the period 1991—2023. 

The model draft envisages a new approach to determining the fundamentals of the constitutional system of Ukraine, the bicameral structure of the Ukrainian parliament—the National Assembly of Ukraine, proposes a presidential form of government (the president is the head of the executive branch), rethinks the entire complex of subjective rights and freedoms of a person and a citizen.

The legal status of the Crimean Tatar Autonomous Republic as a political (national) autonomy of the Crimean Tatar people is also completely new in the draft. The ideological basis of the project is the acquisition of national and general Euro-Atlantic constitutional thought. In the principle issues of freedom of conscience, speech and media the model draft reflects the axiomatic positions of the American (USA) constitutional paradigm.

For members of the National Security and Defense Council of Ukraine, the Commission under the President of Ukraine on Legal Reform, specialists in the field of political sciences, philosophy of law, comparative and national constitutional law, public activists and all those who are interested in issues of the rule of law, modern political and legal theory.
