A court of appeal has upheld the Constitutional Court’s right to not answer information requests which is a legal requirement for all State bodies

The Kyiv Court of Appeal on Thursday, 25 October, rejected an appeal by Media Law Institute lawyer Tetyana Rodionova.  The appeal had been lodged over the ruling of the Sviatoshynsky District Court in Kyiv rejecting Ms Rodionova suit brought against the Constitutional Court. She had been demanding that the Court provide information she requested and moral damages.

The Constitutional Court had refused to provide the information stating that they did not respond to information requests. The Media Law Institute maintain that such a refusal is unlawful since the Law “On information” applies to all State bodies, including the Constitutional Court.

It is likely that the decision will be appealed in the Higher Administrative Court.
